Terms and Conditions

Welcome to the Cake Pop Parlour. By placing an order with us, you acknowledge and agree to the following Terms and Conditions. Please review them carefully before making a purchase.  The Cake Pop Parlour does hold a current Food Safety Certificate (link at bottom of this document).

 

​Product and Services

The Cake Pop Parlour offers handcrafted cake pops prepared in a home-based kitchen.  All products are either sold through direct ordering or Vendor markets.   

​

Ingredients and Allergens

All ingredients are stored and utilized in accordance with the manufacturer's guidelines and within their best-before dates. We take extensive measures to prevent cross-contamination between ingredients. However, please be aware that our products are prepared in a kitchen where allergens such as nuts, gluten, and dairy may be present.

​

Upon request for allergy-free products, the Cake Pop Parlour will implement all necessary precautions to minimize contamination. Nevertheless, we cannot guarantee that any product will be completely free from allergens. The Cake Pop Parlour shall not be held liable for any adverse reactions resulting from cross-contamination, provided the customer has been duly informed.

Cleaning and Disinfection

All kitchen surfaces, cooking utensils and equipment are cleaned and disinfected prior to use. When preparing products, gloves, hair nets, and aprons are used.

Placing Orders, Confirmation, and Payment

The Cake Pop Parlour operates as a home-based business. Orders are accepted based on the Creator's availability, considering their other full-time job and social commitments. Therefore, orders require a minimum of two weeks' notice and can be booked up to two months in advance, as indicated in the availability drop-down menu on the order form. Available dates fill up quickly, so early booking is recommended to secure your event date. Exceptions may apply.

Orders must be placed through the order form on the Cake Pop Ordering page. Upon receipt of the order form, a quote will be provided detailing the order specifics. Once the price and product design are agreed upon, the customer must accept the quote, after which an invoice will be issued. For most orders, a 50% deposit is required upon receipt of the invoice to secure your event date, unless alternative payment terms are arranged.

Design and Order Changes

The Cake Pop Parlour will detail the order specifications and design on the quote or invoice based on communications with the customer. It is the customer's responsibility to thoroughly review the quote or invoice to ensure the accuracy of the order. All orders are created according to the design criteria listed on the invoice. We are not liable for any design issues that were not specified on the invoice.

 

Please note that while inspiration photos can be provided, the final product will not be an exact replica of the photo. We will put our own creative spin on the design to ensure originality and to avoid duplicating the work of other creators. Each product is handcrafted, and while every effort is made to maintain design consistency, slight variations may occur.

Modifications to the order can be made up to seven days prior to the pick-up or delivery date. The customer will be notified of any price adjustments, and an updated invoice will be issued. Change requests made within seven days of the pick-up or delivery date may incur additional charges or may not be feasible, depending on the nature of the request and the notice provided.

Late Payments and Cancellations

Every effort will be made to contact the customer for payment. Invoice payment reminders will be sent on the due date and one day after the due date, as indicated on the invoice.

Customer Cancellations

  • Cancellations made more than 48 hours (2 days) before the pick-up date: The refund amount will be the total price paid minus any time lost or money spent on specialty materials specific to the order, if applicable.

  • Cancellations made within 48 hours of the pick-up date: If full payment is not received by the day of the second reminder (48 hours before the arranged pick-up date), the order will be considered canceled by the customer. Deposits made will be non-refundable, and any ongoing work for the order will cease. Exceptions to this policy must be pre-arranged with the Cake Pop Parlour. Please note, we do not have a storefront for the resale of canceled orders after preparation.

 

Unforeseen Events Cancellations

In the rare event that the Cake Pop Parlour cancels an order due to unforeseen events outside of the business's control (e.g., family emergency, weather event, long-term power outage), a full refund will be provided.

Pick-Up Appointments

Pick-up appointments will be pre-arranged for a specific date and time (within a 30-minute window). The Cake Pop Parlour kindly requests that customers adhere to the scheduled pick-up times, as the Creator may have other commitments outside of these times. Any changes to the pick-up time must be made at least 24 hours prior to the originally scheduled date and time.

Every effort will be made to arrange a mutually convenient pick-up time. However, please note that last-minute changes may not always be accommodated. If orders are not picked up within the scheduled 30-minute window, and no prior arrangements have been made, this may result in the order not being received or the Cake Pop Parlour canceling the order without a refund.

Shelf-life and Storage

Our products are perishable and do not have an extended shelf life like those found in grocery stores or coffee shops. We do not add preservatives to our products. To maintain freshness, it is crucial that products are stored and handled according to the provided instructions. Failure to do so may result in spoilage before the best-before dates.

 

Typically, our cake pops remain fresh from the packaging date as follows:

  • 3-5 days at room temperature

  • 10 days to 2 weeks in the refrigerator in an airtight container or bag

  • 3 months in the freezer in an airtight container or bag

 

All cake pops will be individually wrapped.  All products will also be packaged in boxes unless otherwise specified. The customer assumes full responsibility for the care of the product once it is picked up. At the time of pick-up, the product will be shown to the customer, and care instructions will be reviewed or provided. The Cake Pop Parlour will not be held responsible for any damages or premature spoilage resulting from improper handling, transport, or storage by the customer.

​​Publication

The Cake Pop Parlour reserves the right to publish photos of any product created prior to pick-up, without agreement from the customer.  Any photos supplied to us by the customer will not be published without permission.

​

Customer Satisfaction 

The Cake Pop Parlour is committed to client satisfaction. If you have any concerns regarding product design, taste, service, or presentation, please inform us as soon as possible. We will make every effort to address and rectify the issue. Any refunds or other forms of compensation will be at the discretion of the Cake Pop Parlour, taking into account the amount of product remaining (if there is an issue with the product itself), supply costs, and labor.

Liability Insurance

At The Cake Pop Parlour, we strive to resolve any issues or claims collaboratively with our customers, without the need for insurance or legal involvement. â€‹However, our business is protected by comprehensive liability insurance, which safeguards both our business and our customers in the event of unforeseen incidents. If a formal dispute or claim arises that cannot be resolved internally, it will be addressed through the appropriate channels. The Cake Pop Parlour will not engage in settlements exceeding the original cost of the order without involving our insurance or legal representatives. In the event of a claim, customers must notify us immediately and provide all necessary documentation to support their claim. We will work diligently to resolve the issue promptly and professionally.

Customers assume all risks associated with the consumption of our products if proper storage and handling guidelines are not followed. We will not be liable for any allergic reactions if the customer fails to disclose allergies or dietary restrictions when placing the order. Additionally, customers are responsible for providing accurate and complete information when placing orders and reviewing the order details on the final invoice. The Cake Pop Parlour will not be held liable for any issues arising from incorrect or incomplete information provided by the customer.
